MOTION FOR STEVEN MCCOOL TO WITHDRAW
AS CO-COUNSEL FOR CHAD ELIE
Pursuant to Local Civil Rule 1.4, Steven J. McCool of Mallon & McCool, LLC
(“M&M”) moves this Court for an order granting permission for Mr. McCool and M&M to
withdraw as counsel of record to defendant Chad Elie. Local Civil Rule 1.4, “Withdrawal or
Displacement of Attorney of Record,” provides that “an attorney who has appeared as attorney of
record for a party may be relieved or displaced only by order of the court and may not withdraw
from a case without leave of court granted by order. Such an order may be granted only upon a
showing by affidavit or otherwise of satisfactory reasons for withdrawal or displacement and the
posture of the case, including its position, if any, on the calendar.”
Mr. Elie has been represented by two attorneys thus far in this matter, William Cowden
and Steven McCool. Mr. Cowden is no longer associated with M&M and remains Mr. Elie’s
counsel of record in this case. This withdrawal will not affect any existing court deadlines, M&M
is not asserting or retaining a charging lien, and the government does not oppose this motion.
Wherefore, M&M respectfully requests that this motion be granted.
