Dear Judge Wood:
The Government respectfully writes in regard to an issue it raised in its status letter of
December 17, 2012. As stated in that letter, the Government believes that its motion to strike the
claim of Cardroom International ("Cardroom") (D.E. 203) is ripe for consideration. Counsel for
Cardroom disagrees and believes that the filing of the Second Amended Complaint moots the
Government's motion to strike. The Government disagrees with this position.
The Government and Cardroom have conferred and propose that Cardroom file a ten-page
sur-reply brief in opposition to the motion to strike addressing this issue by January 4,2013, and that
the Government file a ten-page responsive brief by January 14,2013.
Accordingly, the Government and Cardroom respectfully request that the Court So Order that
that Cardroom shall have until January 4,2013, to file a ten-page sur-reply briefin opposition to the
motion to strike addressing its argument that the filing ofthe Second Amendment Complaint moots
this motion, and that the Government shall have until January 14,2013 to file a ten-page responsive
brief,
