As stated in that letter, the Government believes that its motion to strike the claim of Cardroom International ("Cardroom") (D.E. 203) is ripe for consideration. Counsel for Cardroom disagrees and believes that the filing of the Second Amended Complaint moots the Government's motion to strike. The Government disagrees with this position. The Government and Cardroom have conferred and propose that Cardroom file a ten-page sur-reply brief in opposition to the motion to strike addressing this issue by January 4,2013, and that the Government file a ten-page responsive brief by January 14,2013.
