Dear Judge Wood:
The Government respectfully writes to request an extension ofthe deadline by which
the Government may respond to the motion to dismiss that has been adopted by claimant/defendant
Christopher Ferguson. The present response date is today, January 28, 2013. The Government
requests an amended response date ofFebruary 18, 2013. Counsel for claimant/defendant Ferguson
consents to this request.
By way of background, on or about December 18, 2012, the Court issued an Order
(D.E. 292) allowing claimant/defendant Ferguson to convert his memorandum in support of the
motion to dismiss filed by former claimant/defendant Howard Lederer (D .E. 281) into his own
motion to dismiss. In the Order, the Court also established a deadline of January 28,2013, for the
Government to respond to Ferguson's motion.
Since that time, counsel for the Government and counsel for defendant Ferguson have
engaged in extensive settlement conversations. These conversations have not yet resulted in an
agreement.
Because counsel for the Government and Ferguson have spent substantial time over
the past few weeks in the hope of reaching a resolution, the Government respectfully requests, ""ith
the consent of claimant/defendant Ferguson, an additional three weeks to respond to
claimant/defendant Ferguson's motions to dismiss, with an amended response date ofFebruary-HJo;
2013.
