MEMORANDUM OPINION & ORDER re: 51 LETTER MOTION for Conference addressed to Judge Paul G. Gardephe from David H. Pikus dated Oct. 23, 2013 filed by Bank of the Ozarks, 57 MOTION for Summary Judgment (1) awarding plaintiff judgment on its first claim for relief in the amount of $100,000 plus interest based on defendant's wrongful dishonor of a proper draw request and (2) judically declaring that Defendant i filed by Ace American Insurance Company. For the reasons stated above, Plaintiff's motion for summary judgment is granted. The Clerk of the Court is directed to terminate the motions (Dkt. Nos. 51, 57), and to close this case. SO ORDERED.
