We represent Defendants HAG in this action. HAG requests a two (2) day extension oftime
to file its reply brief supporting its motion for summary judgment, D.E. 53. Plaintiff, 2nd Avenue
Deli, DOES NOT OBJECT to this extension. As you may recall, the Court previously set the
Summary Judgment briefing cycle as: Mar. 26 intial briefs due; Apr. 16 opposition briefs due and
Apr. 23 reply briefs due. See D.E. 52, endorsed letter. Due to other filings, HAG needs a short
extension of time for its reply brief.
This delay will not prejudice any party because the Court re-set the briefing schedule by
Order, D.E. 61. A final brief is due May 7.
