PLEASE TAKE NOTICE THAT, upon the Amended Complaint dated April 2, 2012; the
Answer and Counterclaim dated April 11, 2012, the accompanying Memorandum of Law in
Support of Plaintiff Paramount Pictures Corporation's Motion to Dismiss the Counterclaim; the
accompanying Declaration of Nicholas F. Daum dated May 7. 2012, and exhibits thereto; and all
other papers and proceedings herein, defendant Paramount Pictures Corporation will move this
Court, before the Honorable Alison J. Nathan, United States District Judge for the Southern
District of New York, at the Daniel Patrick Moynihan United States Courthouse, 500 Pearl
Street, Courtroom 26B, New York, New York 10007, at a date and time to be determined by the
Court, for an Order, pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure,
dismissing Defendant’s First and Third Counterclaims, with prejudice. The basis for the motion
is set forth in the accompanying Memorandum of Law.
