OPINION: For the foregoing reasons, defendants motion [DI 40, 12 cv 3066] is granted to the extent that Counts II and IV, and Count I except to the extent that it alleges claims for breach of fiduciary duty based on alleged misrepresentations and non disclosures, are dismissed. The motion is denied in all other respects. Defendants request to strike references in the SAC to The Wall Street Journal is denied as moot. (Signed by Judge Lewis A.
