OPINION AND ORDER. For the reasons in this Opinion and Order, Defendant's motion to dismiss is granted. Plaintiff's Fifth Amendment claim is dismissed with prejudice, as any amendment would be futile. Her Fourth Amendment claims are dismissed without prejudice with leave to re-file in the event that her criminal conviction is disturbed. re: 51 MOTION to Dismiss the Complaint filed by Eric Weiss.
