ORDER for 28 Report and Recommendations, 23 Motion to Remand filed by Carolyn W. Colvin, 17 Motion to Remand to Agency filed by Noor Hussain. Because neither party filed timely objections in this case, the Court reviews the R & R for c lear error. Upon review, the Court finds no clear error on the face of the record. Accordingly, the Court adopts the R & R in its entirety. The parties' motions to remand are granted in accordance with the limitations set forth in the R & R, a nd Plaintiff's request for a finding that the April 10 Application was constructively reopened is denied. The matter is remanded to the Commissioner for further administrative proceedings consistent with this Order. The Clerk of Court is directed to enter Judgment. SO ORDERED. This resolves Dkt.
