For the reasons set forth above, IT IS HEREBY ORDERED THAT Defendant's motion for summary judgn1ent as to the First Amended Complaint is GRANTED. IT IS FU RTHER ORDERED THAT Plaintiff's motion for partial summary judgment is DENIED.
