OPINION & ORDER re: 48 MOTION for Reconsideration re; 38 Clerk's Judgment,. filed by Ramon Peguero. For the reasons stated, the Court adopts the Report with the exception of its finding on timeliness, denies the habeas petition, an d denies the Rule 60(b) motion as moot. The Clerk of Court is respectfully directed to terminate docket entry 48 and close this case. Pursuant to 28 U.S.C. § 1915(a)(3), the Court certifies that any appeal of this order would not be taken in good faith. See Coppedge v. United States, 369 U.S. 438, 445 (1962). SO ORDERED.
