OPINION & ORDER re: 99 MOTION to Dismiss pursuant to 12(c) of the Federal Rules of Civil Procedure filed by Christ Cesarz, The City Of New York, Detective Martin, Robert Henn. Accordingly, his failure to intervene claim must be dismissed. For the foregoing reasons, Defendants' motion to dismiss is GRANTED.
