OPINION AND ORDER re: 32 MOTION to Strike filed by Eric B Winter, 28 MOTION to Dismiss filed by Tonya Pinkins. For the reasons set forth above, Defendant's motion to dismiss is GRANTED, and Plaintiff's motion to strike is DEN IED AS MOOT. It is FURTHER ORDERED that Plaintiff is granted leave to file an amended complaint that complies with the standards set forth above. The Clerk of the Court is respectfully directed to terminate the motions pending at docket entries 28 a nd 32. The Clerk of the Court is also respectfully directed to mail copies of this order to Eric Winter and Tonya Pinkins at the addresses provided to the Pro Se Office and listed on the docket sheet. It is FURTHER ORDERED that Plaintiff must submit the amended complaint to this Court's Pro Se Intake Unit within thirty days of the date of this Order, caption the document as an "Amended Complaint," and label the document with docket number 14-cv-8817 (RJS). If Plaintiff fails to co mply within the time allowed and cannot show good cause to excuse such failure, the complaint will be rejected as untimely, and this case will be closed.
