OPINION & ORDER: re: 32 MOTION for Judgment as to the Complaint's First Cause of Action for Discrimination. filed by Eric K. Fanning. For the foregoing reasons, the Court grants defendant's motion for partial summary judgme nt, limited to Morea's discrimination claim under the Rehabilitation Act. The Court respectfully directs the Clerk of Court to close the motion pending at docket number 32. The case will now proceed to trial on Morea's surviving claim fo r retaliation. The Court directs the parties to submit a joint pretrial order, consistent with the Court's individual rules, within four weeks of this order, i.e., by September 1, 2017. Any motions in limine are to be filed along with the joi nt pretrial order. Oppositions to such motions are due one week later, i.e., by September 8, 2017. After receiving the joint pretrial order, the Court will schedule a pretrial conference and a trial date.
