ORDER for 15 Motion to Dismiss filed by Victoria's Secret, 34 Report and Recommendations. On October 20, 2016, this Court referred Defendant's motion to Magistrate Judge Cott for a Report and Recommendation ("R & R"). (D kt. No. 33) On January 27, 2017, Judge Cott issued an R & R recommending that Defendant's motion to dismiss be granted. (Dkt. No. 34) (As further set forth in this Order.) For the reasons stated above, this Court adopts Judge Cort's Repo rt & Recommendation in its entirety, and Defendant's motion to dismiss is granted. The Clerk of the Court is directed to terminate the motion (Dkt. No. 15) and to close this case. The Clerk is further directed to mail a copy of this Order to p ro se Plaintiff by certified mail. This Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
