OPINION & ORDER re: 70 MOTION to Dismiss the Second Amended Consolidated Class Action Complaint, filed by Carlos Jose Fadigas de Souza Filho, Braskem S.A., 73 MOTION to Dismiss , filed by Bernardo Afonso de Almeida Gradin , 96 MOTION to Dismiss , filed by Odebrecht S.A. For the foregoing reasons, the Court (1) grants in part, and denies in part, the motion to dismiss filed by Braskem and Gadigas; (2)grants the motion to dismiss filed by Gradin; and (3 ) grants the motion to dismiss filed by Odebrecht. The Clerk of Court is respectfully directed to terminate the motions pending at Dkts. 70, 73, and 96. An order as to next steps in this case will follow shortly. (Signed by Judge Paul A.
