Building Service 32BJ Health Fund, Et al v. GCA Services Group, Inc.

Filing 54

OPINION & ORDER re: 46 MOTION for Summary Judgment filed by GCA Services Group, Inc.: For the reasons stated above, the Benefits Funds' motion for summary judgment is granted, both as to the Benefits Funds' claims for delinquent payments under CBA I and CBA II, and as to GCA's counterclaims, save that, plaintiffs' claims for delinquent payments that accrued before August 4, 2009, are untimely. To the extent that the Benefits Funds' claims pursue relief based on such payments, the Court grants summary judgment to GCA. The Clerk of Court is respectfully directed to terminate the motion pending at docket number 46. (Signed by Judge Paul A. Engelmayer on 2/3/2016) (tn)
