OPINION AND ORDER re: 37 FIRST LETTER MOTION for Conference re Defendant's proposed Rule 56(a) Motion for Summary Judgment addressed to Judge Richard J. Sullivan from Sidney S. Liebesman dated 2-1-16 filed by Theodore F. Schro eder, 28 MOTION to Dismiss the Complaint filed by Theodore F. Schroeder. For the reasons set forth above, Defendant's motion to dismiss the Complaint pursuant to Rule 12(b)(6) is DENIED; Defendant's request to file his contemplated motion for summary judgment is DENIED without prejudice to renewal following the close of discovery; and Defendant's motion for reconsideration of the Court's February 11 Order is DENIED.
