OPINION & ORDER re: 30 FIRST MOTION to Dismiss the Amended Complaint filed by New York City Department of Education. For the foregoing reasons, the Court grants DOE's motion to dismiss the Amended Complaint. Perez's federa l claims are dismissed with prejudice; Perez's claims based on state and municipal law are dismissed without prejudice.
