ORDER adopting Report and Recommendations for 41 Report and Recommendations, 23 Motion for Summary Judgment filed by Metropolitan Life Insurance Company, 31 Motion for Judgment on the Pleadings filed by Marie Richter. Plaintiff's motion [DI 31] is granted to the extent that her claim for long term disability benefits based on physical disability is remanded to defendant for reconsideration as detailed in the R&R and otherwise denied. Defendant's motion for summary ju dgment dismissing the complaint is granted to the extent that plaintiff's claim that she wrongly was denied disability benefits based on alleged psychiatric conditions be dismissed and otherwise denied.
