OPINION AND ORDER re: 34 MOTION to Dismiss filed by Volpe; 19 MOTION to Dismiss filed by Volpe; 25 MOTION to Amend/Correct 8 30/60 Days Amended Complaint filed by Sherman E. Brown. For the reasons above, th e Court grants Volpe's motion to dismiss the SAC with prejudice, both for lack of standing and for failure to state a claim. The Clerk of Court is respectfully directed to close the motions pending at Dkts. 19, 25, 34. The Clerk of Court is al so respectfully directed to mail a copy of this Opinion and Order to plaintiff at his address of record.
