ORDER ADOPTING REPORT AND RECOMMENDATION for 22 Report and Recommendations. The R & R is adopted in its entirety. (Dkt. 22). The Clerk is directed to enter judgment for the respondent and to close this case. Petitioner has not made a substantial showing of the denial of a constitutional right and, accordingly, a certificate of appealability will not issue. See 28 U.S.C. § 2253; Blackman v. Ercole, 661 F.3d 161, 163-64 (2d Cir. 2011). This Court certifies pursuant to 28 U.S.C. § 1 915(a)(3) that any appeal from this order would not be taken in good faith and in forma pauperis status is denied. See Coppedge v.
