MEMORANDUM AND OPINION. The Court finds that Peerless is liable to First Continental for the legal fees, expenses and costs of defending Stoncor in Arias. As the damages portion of this action was severed from the trial as to liability, the ca se shall be referred back to the Magistrate Judge for a report and recommendation as to the proper damages amount. The Court has considered all of the deposition testimony and other evidence the admissibility of which was placed in issue by the p arties at the trial. The foregoing are the Court's findings of fact and conclusions of law. To the extent they may be inconsistent with any of the disputed evidence, they reflect the fact that the Court found that evidence either immaterial or unpersuasive. SO ORDERED.
