OPINION AND ORDER re: 38 MOTION for Summary Judgment . filed by Monti, City Of New York. The Court has considered all of the arguments raised by the parties. To the extent not specifically addressed, the arguments are either moot or without merit. For the reasons explained above, the defendants' motion for summary judgment is granted. The Clerk of Court is directed to enter judgment dismissing the plaintiff's claims with prejudice. The Clerk is also directed to close all pending motions and to close this case. SO ORDERED.
