MEMORANDUM OPINION AND ORDER re: 26 MOTION to Dismiss Defendants Motion to Dismiss the Complaint Pursuant to Federal Rule of Civil Procedure 41(b). filed by City of New York, Baxter. The defendants' motion to dismiss the Compla int for failure to prosecute is granted in part and the Complaint is dismissed without prejudice. The Clerk of Court is directed to enter judgment for the defendants and close this case. The Clerk is also directed to close all pending motions. SO ORDERED. (Signed by Judge John G.
