OPINION & ORDER: re: 22 MOTION to Dismiss the 9 Amended Complaint, filed by Warden of RNDC, Garrett, Shaaban Morsey, Villa Brerra, Aponte, Presley, New York City Health & Hosp Corp Policy, The City, Simon, Harris, Ross McDonald, Kumar. For the reasons articulated in the Report, the Court dismisses Turner's complaint without prejudice. The Clerk of Court is directed to close this case.
