OPINION AND ORDER: re: 26 MOTION to Dismiss The Amended Complaint, filed by The City Of New York, Assistant Commissioner of Bits Wallace, The Fire Department of New York. The Court has considered all of the arguments raised by th e parties. To the extent not specifically addressed above, the arguments are either moot or without merit. For the foregoing reasons, the defendants' motion to dismiss the Amended Complaint is granted. The Clerk is directed to enter judgment dismissing this case.
