OPINION & ORDER re: #8 MOTION to Dismiss filed by The Hinrichsen Foundation. For the reasons set out above, Christian has failed to establish, under the standards governing Rule 12(b)(2) motions made at this stage of litigation, that this Court has personal jurisdiction over the Foundation. The Court therefore dismisses this case. The dismissal is, however, without prejudice to Christian's right to file another lawsuit, in any forum, making similar claims against the Foundation, provided that he can then plead facts sufficient to support a finding of personal jurisdiction. The Clerk of the Court is respectfully directed to close the motion pending at Dkt. 8, and to close this case. (Signed by Judge Paul A. Engelmayer on 1/9/2018) (mro)
