The Court has considered all of the arguments raised b y the parties. To the extent not specifically addressed above, the arguments are either moot or without merit. For the foregoing reasons, the defendants' motion to dismiss Captain Agard is granted. The Clerk is directed to close the motions at docket numbers 24 and 30. SO ORDERED.
