OPINION AND ORDER re: 1 MOTION to Vacate. filed by Dany Kogan. The Court denies Kogan's habeas petition under Section 2255. The Court will not issue a Certificate of Appealability. Kogan has not "made a substantial showing of the d enial of a constitutional right" pursuant to 28 U.S.C. § 2253(c)(2). No "reasonable jurists could debate whether (or, for that matter, agree that) the petition should have been resolved in a different manner." Slack v. McDaniel, 529 U.S. 473, 484 (2000).
