I am the Assistant Cmporation Counsel in the Office of the Cmporation Counsel of
the City of New York assigned to represent Defendants New York City Depa1t ment of Education
("DOE") and DOE Chancellor David C. Banks in the above-referenced matter, in which Plaintiffs,
parents on behalf of two students, allege that their rights were violated due to alleged systemic
delays in providing coord inated nm-sing, transpo1tation, and po1ter se1v ices.
I write to res_ ectfull re _uest a brief two-business-dj!Y extension of time, from
Febmar, 16, 2024 until Febmar, 21 , 2024, for the pa11ies to submit their Objections to the Repo1t
and Reco1mnendation on the Cross-Motions for Smmnaiy Judgment dated Januaiy 26, 2024 (ECF
No. 322) ("R & R").
By Order dated Febmaiy 1, 2024 (ECF No. 324), the Comt granted Plaintiffs '
request for a one-week extension of time for the pa1t ies to file objections to the R & R. Plaintiffs
do not object to the instant request, and this is Defendants' first request for such an extension.
The reason for the requested enlaiĀ·gement is that I was out sick for the majority of
last week, and, as such, I require additional time to finalize Defendants' motion papers.
I thank the Comt for its consideration of the within request.
