For the reasons explained above , the defendants' motion for summary judgment is denied and the plaintiff's motion for summary judgment is granted. The Clerk of Court is directed to close the motions at Docket Numbers 57, 66, and 70. The plaintiff is directed to submit a proposed judgment and a supporting brief by March 22, 2019.
