OPINION AND ORDER re: 58 MOTION to Dismiss Plaintiffs' Third Amended Complaint filed by Consolidated Edison Company of New York, Inc. For the foregoing reasons, Defendant's Motion to Dismiss is hereby GRANTED as to Plain tiffs' claims of fraud and violations of New York insurance law. Further, Defendant's Motion is hereby GRANTED regarding the retaliation claims alleged by Plaintiffs Morris and Moses only. Defendant's Motion is otherwise DENIED. SO ORDERED.
