Dear Judge Oetken:
This Office represents Treasury Secretary Steven Mnuchin, in his official capacity; the
U.S. Department of the Treasury; Commissioner of Internal Revenue Charles P. Rettig, in his
official capacity; the Internal Revenue Service; and the United States of America (together, the
“Government”), the defendants in the above-referenced action. The parties write jointly with
respect to the Standing Order that was entered in this matter on December 27, 2018 (Dkt. No.
50), and its effect on the pending briefing deadlines that were previously entered by the Court
(Dkt. No. 49), to ensure that the record reflects the parties’ understanding of the now-applicable
deadlines. The parties have conferred and agree that, since the Standing Order tolled all
outstanding deadlines by 35 days, the dates reflected in the Court’s last scheduling order (Dkt.
No. 49) are adjusted as follows:
The Government shall file its reply and opposition on or before February 28, 2019; and
The States’ reply shall be filed on or before March 15, 2019.
We thank the Court for its consideration of this matter.
