For the foregoing reasons, the claims against Scott, Advise, Martinez, Capers, and CEJ are dismissed without prejudice to the claims' being refiled in a co urt of competent jurisdiction. Plaintiff's motion for reconsideration is denied. The Clerk of Court is directed to remove Dkt. 139 from the Court's list of open motions and to close this case..
