On September 14, 2020, the Court held a conference in this case. As the Court stated at
the conference, the motion of Plaintiff GOJO Industries, Inc. to dismiss its complaint with
prejudice, pursuant to Rule 41(a)(2) of the Federal Rules of Civil Procedure, is GRANTED. The
parties shall bear their own costs and fees in connection with that complaint.
IT IS FURTHER ORDERED that, by September 18, 2020 at 3:00 PM, the parties shall
file a letter informing the Court whether they were able to reach a settlement with respect to the
counterclaim complaint of Defendant Innovative Biodefense, Inc.
IT IS FURTHER ORDERED that the parties’ request to extend the deadline to complete
discovery and file any post-discovery dispositive motions is DENIED.
