ORDER TO SHOW CAUSE: Accordingly, by November 20, 2023, Plaintiff will show cause why this action should not be dismissed with prejudice for failure to state a claim due to the invalidity of the '067 Patent. Given the Order to Show Cause, De fendant's request for a conference regarding the renewal of its motion for judgment on the pleadings is denied without prejudice. In the event that the Complaint is dismissed, Defendant will submit a letter proposing a briefing schedule for its anticipated motion for an award of attorneys' fees.
