DECISION AND ORDER VACATING THE BANKRUPTCY COURT'S ORDER ENTERED FEBRUARY 27, 2024 AND STAYING THE ADVERSARY PROCEEDING PENDING ARBITRATION. The Bankruptcy Court's order is vacated. For the reasons discussed above, this court directs that the parties shall immediately submit the disputes pleaded in the Adversary Proceeding Complaint to arbitration in accordance with the AAA Rules for Commercial Arbitration. Any challenge to the arbitrability of any claim asserted in that pleading is reserved for the arbitrator. The Adversary Proceeding is stayed in the Bankruptcy Court pending arbitration. This constitutes the decision and order of this court on appeal. The Clerk of Court is directed to remove this appeal from the court's list of open items.
