Accordingly, Plaintiffs claims against Defendan t Superintendent are dismissed with prejudice, pursuant to Federal Rule of Civil Procedure 12(b)(5), and Plaintiffs claims against the John Doe Defendants are dismissed with prejudice, pursuant to Federal Rule of Civil Procedure 12(b)(6).
