OPINION AND ORDER re: 29 CROSS MOTION for Partial Summary Judgment on the Issue of Liability filed by United States of America, 26 MOTION to Dismiss Complaint filed by The County of Westchester, New York. For the reasons stated above, Defendant's motion to dismiss and Plaintiff's cross-motion for summary judgment are both DENIED.
