Houston v. Capra et al

Filing 78

ORDER, It is HEREBY ORDERED that plaintiff's deadline to file his amended complaint is again sua sponte extended to May 26, 2021. Accordingly, by May 26, 2021, plaintiff must either (i) file his amended complaint or, (ii) indicate to the Court in writing that he wishes to proceed with this action by relying on his original complaint. Failure to comply with the Court's order may result in dismissal of the action for failure to prosecute or comply with Court orders. Fed. R. Civ. P. 4 1(b). The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962). Chambers will mail a copy of this Order to the address listed on the docket. SO ORDERED. ( Amended Pleadings due by 5/26/2021.) (Signed by Judge Vincent L. Briccetti on 4/26/21) Copies Mailed By Chambers. (yv)
