ORDER that Petitioner's motion for appointment of counsel is denied without prejudice as premature. Respondent's shall file and serve an answer and memorandum of law to the petition by 3/5/06; petitioner shall have 60 days upon the receipt of the answer to file written response. The Clerk of Court shall serve a copy of documents #1, #3, #4, #5, #6 together with a copy of this order by certified mail upon respondent Superintendent of Five Points Correctional Facility and upon the Assistant Attorney General (Rochester, NY).
