ORDER directing that the two letters submitted by the plaintiff dated 4/6/09 and 4/10/09 shall be filed and docketed in 09cv328; that 09cv328 shall be closed and that the complaint in 09cv328 shall be docketed in 08cv506 as an amended complaint and t he Clerk shall cause the U.S. Marshal to serve the summons and amended complaint on defendant T. Steven in 08cv506; a copy of this order shall also be docketed in 08cv506; if defendant T. Stevens has been served already with the summons and complaint in 08cv506, as previously directed, he is relieved of any obligation to answer or otherwise respond to that complaint and is hereby directed to answer the amended complaint in 08cv506; in the event defendant has been served in 08cv506, the Clerk of Court is directed to forward a copy of this Order to the Assistant Attorney in Charge.
