ORDER denying 2 Motion to Appoint Counsel ; granting 2 Motion for Leave to Proceed in forma pauperis; denying as moot 3 Motion for marshal service. Further, plaintiffs must inform the Court in writing no later than 4/1/10 whether it has retain ed counsel on behalf of Kodey Mills and whom that counsel is. If plaintiffs do not so inform the Court of that information by that date, the Clerk of Court is directed to dismiss Kodey Mills as a party to this action without further order or notice to plaintiffs.
