ORDER that the Clerk of Court is directed to cause the U.S. Marshals to serve the summons, amended complaint and this order upon defendants Sergeant Leonarde and Correctional Officers Victor, Damstetter and Connoley at the Attica Correctional Facilit y, without plaintiff's payment therefor, unpaid fees to be recoverable if this action terminates by monetary award in plaintiff's favor; defendants are directed to answer the amended complaint. Further, Clerk of Court is directed to forwar d a copy of this Order by email to Michael Russo, Assistant Attorney General (Buffalo). Further, plaintiff must file a response to this Order and show cause why the Second through Seventh Cause of Action should not be dismissed by 6/3/13. Further i f plaintiff fails to file a response to this order by 6/3/13, the Second through Seventh Cause of Action shall be dismissed with prejudice without further order and leave to appeal to the Court of Appeals as a poor person denied.
