ORDER that the Court intends to re-characterize the instant petition as one brought under 28 U.S.C. section 2254. Further, the re-characterization will occur unless petitioner notifies the Court in writing by 3/1/14 that he either consents to re-cha racterization or voluntarily withdraws the petition. Further, if petitioner does not advise the Court in writing by 3/1/14, the Court will re-characterize the petition as one brought under section 2254. Further, respondent may file a response to th is Order by 3/21/14. Petitioner may file a reply to any response of respondent by 4/5/14. Further, the Clerk of Court shall serve a copy of the petition, together with a copy of this order, electronically via Notice of Electronic Filing to Alyson Gill and Arlene Roces of the Office of the Attorney General, Federal Habeas Unit.
