DECISION AND ORDER granting in part and denying in part 32 Motion to Dismiss for Failure to State a Claim. The motion is granted with respect to Plaintiff's Title VII claims against Dr.Levy individually, which are dismissed without prejudice. The motion is denied with respect to Plaintiff's NYSHRL claims against Dr. Levy individually, which may proceed. The following claims are dismissed without prejudice: (1) Title VII claims against UBNS; (2) NYSHRL claims against UBNS; (3) § 1983 claims against both UBNS and Dr. Levy; and (4) tortious interference claims against UBNS and Dr. Levy Signed by Hon.
