DECISION AND ORDER re 11 MOTION for Default Judgment will be addressed through an inquest that will be arranged in a separate Order. Time for service is extended an additional 120 days from the date of entry of this Order. The Clerk is directed to send a copy of the Complaint and Order to the Assistant Attorney General. Response is due by 4/30/09. The Clerk is directed to cause US Marshal to serve copies of Summons, Complaint and Order upon New York State Attorney General Andrew Cuomo, former- Governor Spitzer, Commissioner Fischer, Superintendent Napoli, Corrections Officer McCracken and Hearing Officer Esgrow.
