-CLERK TO FOLLOW UP-ORDER granting in part and denying in part 12 Motion for Summary Judgment. All claims against defendant The City of Rochester Police Department are dismissed. Plaintiff's federal claim is dismissed. The remaining claims are dismissed without prejudice pursuant to 28 U.S.C. Section 1367. Pursuant to Section 1367(d) plaintiff shall have the longer of thirty (30) days, or a length provided by New York state law in which to refile the remaining claims in state court. SO ORDERED.
