ORDER granting #26 Motion to Modify Court's Order. It is ORDERED that the Joint Motion to Modify Order is GRANTED; the hearing on Plaintiff's Motion for a Temporary Restraining Order is CANCELLED and all deadlines set forth in the Court's Order of 9/12/2007 are VACATED. All discovery necessary for determination of the motion will be completed no later than 10/5/2007. The parties will submit to the Court a motion-related discovery plan no later than 9/18/2007. Each party will serve its primary brief on the motion no later than 10/9/2007. Reply briefs may be served by 10/11/2007.
